The arbitrator shall have the power to proceed with the arbitration and to deliver their award notwithstanding the default by any party in respect of any procedural order made by the arbitrator. The decision arrived at by the arbitrator shall be binding. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. Notwithstanding the above, nothing in this section 15.8 shall remove the legal rights or remedies of appeal available to the Parties under the Arbitration Act, 1991 (Ontario). In the event that any of the above in this Section 15.8 is found invalid by a court of competent jurisdiction, the provision shall be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provision of this Section 15.8 shall remain in effect.
